TERMS AND CONDITIONS

These terms and conditions apply between you as a customer / guest ("you / you / your") and Happy Biscuit AB ("we / us / our / our"). Happy Atelier is the collective name for the company that runs Happy Biscuit AB in the Stockholm area and the e-commerce service at www.happyatelier.se ("the site"). Happy Biscuit AB, Org. No. 559 154-4837. These general terms and conditions apply to all transactions that take place through the site.

These terms and conditions may change and the latest update date will always be in the title. No information will be provided when the terms and conditions change, but it is up to you to keep yourself updated about any changes. If you do not agree to these terms and conditions, do not use the site.

By creating an account and / or using any of the services on the site, you accept these terms and conditions. You are responsible for storing your login information to the site and your customer number so that they can not be misused by unauthorized persons.

To be able to make a purchase at the site, you must have full legal right to enter into an agreement, you must be over 18 years of age. If you represent a legal person, you may only use the services on the site if the legal person has given you permission.

The services on the site

On the site you can order food and / or drinks, either for delivery  or for pickup at any of the physical Happy Atelier store. The site contains detailed information about the content of the products, and the presence of any allergens.

Cooking for the food delivered is done daily in our preparation kitchen at Hantverkargatan 47 in Stockholm. In addition to the food we prepare ourselves, we also sell third-party products,only for some drinks.

On the site, you can get information about Happy Atelier, where we are located and our opening hours. Through your account on the site you will have access to "My Account" where you update your customer information

In case of suspicion of abuse of the services on the site, we are entitled to refuse to process a submitted order and to terminate an existing account.

We strive for the site to always be available but accepts no liability for any malfunctioning that may occur.

 

Price and payment

Prices are those stated on the site the day the order is placed. All prices are quoted including VAT unless otherwise stated. We are entitled to change prices without prior notice.

Payment is made by bank card, debit card or invoice with 10 days payment time. The cards accepted are determined by the provider who provides our payment service, not iZettle. iZettle is one of Swedbank's wholly-owned companies and all communications related to card payments are encrypted according to SSL (Secure Sockey Layer). We save truncated card details with us in order to provide a receipt for purchase and a reference number required for the dialogue with the payment service company,

 

Invoice Customers

Only companies are currently offered payment by invoice.

Business application is either made automatically when the first order is placed or you can make a separate application without first making any purchase on the site . When you are assigned a customer number, you can, in addition to making a purchase on the site, purchase invoices in Happy Atelier store.. You are responsible for unauthorized access to your customer number, as well as for all transactions that are entered with your customer number or login to the site.

We reserve the right to deny payment against invoice.

It is your responsibility to have the correct invoice information registered. We will not correct an invoice because you have entered incorrect or incomplete billing information.

 

Delivery

The site shows during which times and within which areas we can deliver ordered goods. If you choose to pick up in the store then check  the address of the store before completing your purchase. 

Delivery with bids is done at the shipping address you provided when you registered your account or when you placed the order on the site. You are responsible for keeping your shipping information up to date and the correct shipping address is listed on each individual order.

We are responsible for the goods until they are delivered to the shipping address you specified when you placed your order. You are responsible for the presence of someone who can receive delivery during the specified delivery time. If no one is not available to receive the goods, you will still be charged the regular price according to the order confirmation.

Ordered goods are delivered within the time specified in the order confirmation. In case we can not deliver within the specified time, we will contact you to agree on a new delivery time or cancel the order. We will contact you by phone or email and use the information you registered on the site.

If we can not deliver within the time limit, you are entitled to refuse to receive late items and then no debit will be made, either of the goods or of the freight. No further compensation is taken from our page for late or missed deliveries.

 

Complaints & Remedies

Private individuals are often covered by the right of withdrawal under the Distance and Home Sales Act (SFS 2005: 59). However, this does NOT apply to the foods we provide because they are not of a nature that allows them to return. Ordered, disposable goods delivered on time can not be advertised and no refund may be applicable.

However, if something would be wrong with the content of your delivery, please contact us immediately so that we are able to correct the error. If we can not correct the error, our responsibility is limited to the value of the goods delivered.

 

Force majeure

Should a situation arise which may be considered beyond our control, called Force Majeure, which prevents us from fulfilling our commitments, this does not constitute a breach of contract and we can not be liable for damages. Even in Force Majeure situations, we will always try to fulfill our commitments to you as far as possible.

 

Privacy Policy

By voluntarily submitting personal information on the site you allow us to process the information in accordance with this policy and applicable law. You may at any time inform us that you wish to withdraw this consent. In that case, no further processing of your personal data will take place.

All personal data is stored according to GDPR. We register and store your personal information to:

  • be able to deliver your goods

  • be able to charge you

  • If necessary, contact you

  • able to provide you with good service, including giving you your order and transaction history

  • meet the legal and regulatory requirements imposed on us

  • collect and analyze information to customize offers and discounts on products and services

  • be able to conduct marketing measures

Personal data may be disclosed to third parties that we cooperate with for the necessary treatment for ours, for example for analysis and distribution, etc.

For the above purposes, we need to combine our records with all companies within the Happy Biscuit AB.

If you do not want your personal information to be used for marketing purposes, you can also make a written notification and request that this terminate.
